Ok so Here's the situation'
I sold a bike to a bloke that lives about 40 miles from me, he came & gave it a test ride (only around the block) then paid & picked it up on a friday pm & rode it home , i got a message on Saturday morning saying "great bike thanks" i know now that he had it up the feilds over the weekend,He even told me i love the bike it pulls a wheelie at ease" then on monday i got another message saying
" you must have known the gearbox was shot" "i want to bring it back or get some money back!!"
Now i'm 100% sure it was ok , i would never rip anyone off!
I said i would get the gears if he was prepared to fit them & he was OK with that,
Then today he says "my wife has gone through my phone & is making my life hell i want to bring the bike back!"
Now what i'm asking in your opinion would i be out of order in saying no but i will still supply the parts if he gets it repaired ???

No, you wouldn't be out of order at all. A private purchase is always a risk and with very very little legal comeback on the seller. You are fully within your rights to laugh at him, should you choose, though obviously that would neither be nice nor advisable!

That you have offered to contribute to the cost of repairs is the best he can hope for. No one ever likes to be ripped off, and I'm not suggesting that's what you've done, but by the same score, how can he prove he hasn't given it a thorough caning over the weekend?

The call is yours to make, you are not obliged to do anything whatsoever!

Sounds more like he has thrashed the bike but more importantly it was a private sale and the bike was running perfectly well enough for him to make the purchase.

Your offer of supplying the parts is more than fair imho.

I wouldn't even supply the parts it's a second hand bike that he's ridden and you don't know what's been done to it whilst he's had it

No way should you take it back,your being decent enough even offering to buy the parts.Everyone knows it's "buyer beware" when you buy a second hand bike privately.If you want a warranty pay a dealer for it! You've nothing to feel bad about if you genuinely didn't know there was problem.Shit happens!
I had a similar thing happen to me when I bought the car I've got now.I'd agreed to buy a diesel turbo of a guy 50 miles away.The guy seemed genuine enough,telling me it had just had a second hand turbo fitted after the original had blown.Had a test drive,everything was fine.He even offered to deliver it for me during the week but as I wouldn't be at home then I said I'd meet him half way at the weekend.So did the deal and half way home the turbo blew again.I did phone him and tell him what had happened and he was very apologetic and offered me back £150 towards repairs.There was no point me ranting and raving and demanding my money back as I knew he could have just told me to f##k off.So I gladly took the money and put it towards the £1000 it cost to get a reconditioned one fitted.I wasn't very happy at the time but like I said,shit happens!

Personally I'd feel bad about a bike I'd just sold not working properly, but as others have said, how do you know it hasn't been damaged by the new owner?

One possible compromise, the new owner fully repairs it, at their expense, with the bills to prove it, and then you buy it back subject to you being happy with a test ride.

I wouldn't entertain it, the buyer is a chancer

If you feel duty bound then offer him a few quid towards repairs

10 years ago.......I bought a BMW R100GS PD off a mate who was hardish up (new bike purchase on the way and he couldn't sell the PD) so I bought it

I test rode it, plus the previous year we'd toured the Picos and Pyrenees togther and the PD was fine in 2500 miles

First ride, only 20 miles and the bevel box seal went and all the FD oil leaked over the rim and tyre outside the cafe (it is a BMW )

There's no way I told him, it wasn't his fault and i just got it repaired locally - it cost about £200

We're still very good mates and he knows nothing about the bike shitting it's oil

Similar thing happened to me, sold a bike guy test rode it was happy with it, I even gave him £20 back because the front brake switch had failed and told him where to order one. 3 days later threatened to take me to court as the bike in his opinion wasn't road worthy, he listed a heap of faults, none of which were there with me, I'd done an 80 mile trail ride the wek before. He even complained that there were no indicators ( there were none fitted in the pics or when he bought it) threatened to take me to court and everything.
He didn't like the letter I sent back recorded delivery, (brothers a solicitor) I still stand by that the bike was absolutely fine when I sold it, it was too big for me and I made sure he knew everything about it, I think he just felt he'd overpaid for it (he hadn't) and was trying it on.
I would tell him caveat emptor - buyer beware! If it. Happened to me I wouldn't have the brass neck to ask for anything back , I'd take it on the chin.

Sorry sold as seen. If he was that bothered he should have got a mechanic to check it out first. Tough really.
