If I was the coach driver, I'd appeal!

It's the coach driver who was on trial. It doesn't matter if the other guy was the biggest idiot in the world, the only thing that is under consideration in the courtroom is the coach drivers actions. No basis for appeal because of the other guy.

Absolutely. The car drivers actions, be they legal or otherwise did not contribute to the fact that the bus driver ignored the red cross denoting the closure of the hard shoulder.
