just watched this on another forum and it was asking whos at fault here

Found a great video then post it up here. It doesn't have to be about bikes.

Insurance will say it is the overtaking vehicles fault, whether the scooter moved to the right or not. As an ex cop I would of had a run at dangerous driving the way the guy slammed the brakes on in front of the scooter let alone anything else.

I find it very interesting how the jag drivers attitude changes when he realises he is being filmed. the scooter rider did not do himself any favours by swearing, but that could of been put down to "shock"

Personaly on a cycle or bike I dominate the road and I will not move to the left because that only invites someone to try and over take, if it is safe to over take it does not matter if I am in the middle of the road or not.

would be interesting to find out what happens with the insurance claim cheers Spud ;)

The scooter rider was at fault, but the car drive was also at fault for not waiting for the scooter to move over.

If I'd been called to that scene (Ex-Rozzer) and shown that video I would've reported the scooter rider and for driving without due care and attention, and the driver for careless and inconsiderate driving.

I know thats gonna be unpopular on a bike forum but thats the way it is I'm afraid.

Impartial and unprejudiced.

I'd have to disagree there. The road may be two lanes wide, but there is no dividing line to identify a two lane road. Therefor the absence of a dividing lane marker indicates the road is a single lane. Correct Road marking is everything and in this case there aren't any.

This bloke needs to be taught a lesson. He didn't allow enough room for the scooter on the overtake, he was responsible for hitting the guy as he has come from behind and should have waited to see what the guy was going to do (and also to make allowances for him as he is on L plates) and not only that he aggresivly cuts in front of the guy and slams his brakes on. Totally Irresponsible behaviour.

Err, bit late disagreeing with Jelly. I already sorted him out and he had to surrender.

:woohoo:   B)

I post replies as I read the post and don't read the whole thread first before posting. I saw your results on Jelly a few posts later LOL... ;)

I'm sorry but if someone tries to kill me and then is foolish enough to stop and shout at me after then they are unlikely to survive the encounter.

I only had lessons in the UK and passed my test in Germany but, even if the exit was two laned the scooter is not bound by any ruling to use the left lane.

Maybe having the camera calmed the scooter rider down, I'm not sure what I would have done but wearing a helmet and Kevlar gloves makes my feel superior to fat jag drivers forcing their way and feeling threatened by the drivers actions I would be defending myself. The car was being used like a weapon.
