Dear Tony
Thank you for your email regarding the above. Norfolk County Council are not proposing to change the status of this public road but have received a definitive map modification order (DMMO) application from a member of the public for this route (U33310) to be registered as a restricted byway. I have written to the applicant to ask them whether they are willing to withdraw their application on the basis that the route is already registered as an unclassified county road and is therefore of a higher status than a restricted byway.
If the applicant is unwilling to withdraw their application then we would likely end up registering the route as a byway open to all traffic (BOAT) as it is recorded on the list of streets which immediately pre-dates the implementation of the Natural Environment and Rural Communities Act 2006 and would therefore have its vehicular rights preserved.
I am of the opinion that entering into the DMMO process for this route which is already a county soft road is an unnecessary use of our limited time and resource and hope the applicant will agree with me and be happy to withdraw their application and leave things as they are.
Many thanks
Ian

Re: Norfolk Lane Under Threat.
I do wonder why a member of the public would want to alter the status of the route Ive never seen a walker a horse or a cyclist use the route which is very remote and unmarked and were it not used by motorcycles and were it not for the efforts of the riders to keep the route open it would fairly quickly be swallowed up by the very dense surrounding woodland I do really think that these "members of the public" should have to make their motivations and any vested interests clear when making such requests.

If you've got a shoot, then perhaps you would like to see the road closed so your 'guns' can shoot across it?

Re: Norfolk Lane Under Threat.
The application to turn this unclassified road into a restricted byway was made by a Dr P Wadey who lives in 200 miles away in Wilshire !! and is chairman of the British Horse Society.Ive never seen a horse use these lanes nor could they whilst they are manageable on a bike the dense low hanging surrounding woodland makes them impassable for anyone on horseback.

Re: Norfolk Lane Under Threat.
It's a shame that the BHS has been largely taken over by 'antis'...sadly British Endurance is no longer part of the BHS, so the TRF no longer has the lever of stopping its members helping at horse trials.

The BHS has 92,000 members and 34,000 affiliated members rather more than the 5,000 TRF members and you would assume they're somewhat better connected .
