Why was he riding on the inside? If a car is indicates left then drifts right, back off.
Why didn't he brake?

I normally complain about car drivers...and it's easy to say with hindsight. But why go up the inside of that car? Even if you think it's going right, it IS indicating left. Back off and see what it does first.

No reason to go up the inside of that car.

Seems to me the driver was indicating to come off the round about. He,d diddent intended to go into the garage, changes his mind, brakes and cuts across the inside lane. Not saying the rider was blameless but the driver was an ass. IMHO.

But when you're the one laying on the floor with a broken leg (not in this case obviously), does it really matter if the car driver was an ass??

Don't matter what he 'thinks' the cars doing, going up the inside when he's got an indicator on is a fools decision.

I'd put good money down that his insurers never see the video.

100% his own fault.

I have seen a few of these.

Car driver did not clearly signal, he used signal to show left off the roundabout but made no subsequent effort to signal an intention to turn into the left. He then moved over to the right as if changing lanes and left a large space. The intention to turn into garage was not clearly signalled and car driver did not check the way was clear, especially as he should have seen there was a motorcycle behind. Bad road position on part of car driver.

A lot of us would not have gone into the gap because of the possibility of this left turn happening but that's for us all to learn from.

Insurance is less clear and its my hunch the insurance might go 50/50 but I have seen instances of the car driver being found wanting. In the scheme of things though then car drivers positioning on the road is key to his intention and that does not at all suggest an intention to turn left.

But, again, a lot of us would not have gone in that space, maybe. I only say maybe because it looks like there is a turn to the right just up ahead and one could assume the car driver was making for that which would justify traffic in the left lane legally 'undertaking' the slower traffic in the right hand lane.

Someone working in my office years back got caught like that, car driver was held 100% responsible due to 'failure to properly signal in good time and failure to keep a proper lookout'.

Added: Look again at the video and the car driver has actually gone over onto the other lane, look at the white lines under the car, then come back. I would give the video to a smart lawyer.
