Sometimes think it might be easier for us up here in Scotland.
I just ride where I like. I rarely meet anyone and when I do it's even rarer for them to be upset by me being there.
Riding on private land is a civil matter so cops aren't interested and as long as you are insured they are happy for you to right anything they consider as a right of way.
If I'm in forestry, the workers don't care, and owners can simply tell you to piss off, which is fine, you just piss off, no drama, just go back another day.

I picked up on this comment "Riding on private land is a civil matter so cops aren't interested and as long as you are insured they are happy for you to right anything they consider as a right of way." But having researched it I still think the police can intervene under section 59 as you are riding on private land WITHOUT permission?--what is the correct situation--and I'm interested in land that is PRIVATELY owned and not a park, common etc where its under the control of councils or the crown.

Section 59 relates to obstructions.

Well, in England, if you are caught riding your trailbike where you shouldn't, then they will confiscate it.
There is, however, a defence.
Acquire a big black pick-up truck, a Sprinter van and a chrome-plated caravan, park the lot on a playing-field and then tear around on a pit bike, and it becomes a civil matter. You can do it for four days until the council pin a notice to the gate, then you go on to the next village and do it there instead.
