Accident advice needed

My son came off his scooter last night, he was approaching a car which was parked on the opposite side of the road, a car approaching from behind the parked car pulled out onto my sons side of the road, he hit the brakes and it being cold and him inexperienced he locked up and came off sliding down the road, he didn't hit anything but has scraped his scooter, ripped jacket etc, big old bruise on his hip (which the way he makes out must be fatal or perhaps even slightly worse :D ) but limped away from it.
Is the other driver liable? Would be nice to get the bits on his scooter repaired and a new jacket out of the other driver seeing as it was his fault, wouldn't care but he had lights on, high vis jacket and a white helmet so not exactly invisible

Probably worthwhile asking the advice from a lawyer who specialises in motorbikes, for example: https://www.whitedalton.co.uk/

What will be of help is if there were any witnesses I'd guess.

Worth having a go off the guys insurers but as said a lawyers advice is good. I was in such a situation years ago and all material damage ended up paid for.

If I could work out how to delete all that I would, seemed a good idea at the time :mrgreen:

To be honest the damage amounts to probably £150 - £200 quid and not worth trying to chase but interested to know peeps take on it, not sure what happens when someone causes an accident but you don't actually hit them, got to be hard to prove.

Tricky one. As you say, if he never hit the car then there was plenty of time to stop, for both parties. So speed cant have been an issue?

How wide was the road, may be worth taking photos of where it happened. eg theres normally space for a parked car and a car and bike to pass with no issues. Sometimes theres not enough space if the road is narrow, in which case then yes, Id say its the fault of the driver for pulling out. But as the car wasn't hit then Id think you would struggle to prove anything.

Hope it doesn't put him off bikes. These things happen.

What is his excess on the insurance.
Have you got the drivers details might be worth just having a chat with them they may have some sympathy with the lad and contribute to some repairs. ( Long shot I know but there are still some decent people out there)
But to be honest probably best to just chalk it up to experience.
Hope it hasn't put him off, and every scar tells a story of heroism and the ladies love heroes.

What happened in my case was one question: with the car parked on the other drivers side, did the offending driver have to cross into the opposite side of the road? A simple tape measure proved it, but it was apparent anyway as it was quite narrow.

Its also an experience as car drivers will regularly do that, even now I see them do it while looking down at a phone, happened 12 months ago but I saw the guy was paying no attention. I stopped but he woke very suddenly up when I rapped his door mirror as he passed.

My advice to your son is pick yourself up, dust yourself down and carry on.

As soon as you involve insurance companies with a teenager in an RTA you will find renewal premiums being 'adjusted' so he ends up paying out far more than a couple of hundred quid in the next five years.

Even a complete 'no fault' accident can see insurance premiums go up for the injured party. At best, your son would be regarded as being 50% to blame, so you'd probably end up with a £50-£75 payout. Not even worth the time to fill in the form.

I'd send your son on an off-road riding course, where he can learn how to brake safely on slippery surfaces, and perhaps do some advanced training so he can learn how to anticipate all the mistakes that people will make around him in future years.
