I sold a bike to a member of this forum.
He paid my full asking price. He then sent the bike to a well respected mechanic and race prep guy to have some mods and farkles fitted.
The mechanic turned up some defects that I was unaware of.
Not too expensive to correct, but baring in mind he'd paid my full asking price for the bike when he added on the essential extra work to bring the bike to a good roadworthy standard it probably would mean that he'd paid too much for the bike.
So without hesitation I refunded his money in full and took the bike back, I even travelled a 450 mile round trip in my van to collect the bike.

Ted

Get the bike checked to provide what is termed 'expert evidence' that it is not roadworthy. One you have that then he cannot refute the fact that its not roadworthy. you need to do that soonest as that will constitute fact rather than hearsay or verbal. Keep the messenger detail but you need to do it ASAP in case he tries to argue that you did subsequent damage. It doesn't matter that you don't have the documentation that he had it inspected, in fact the absence of same may well suggest that he possibly lied anddidn't have it inspected or worse that he did and concealed the report.

I am aware of another forum where someone bought a bike and it turned out not to be right. In fairness to both parties the was an immediate refund and return of the bike although I personally think that because of the condition the buyer would have been better to keep it and sort a suitable financial settlement. But it was all done without any hassle so credit to that vendor too.

I looked at another bike recently and the vendor assured me all was in order. It looked great and started fine etc. But when I went for a test ride I found I was looking at some expensive fixes like head bearings, tyres badly aged out, leaky rear main seal [it was a BMW] and some leaky master cylinders. I didn't go with it as I was already doing the same list to my own one.

I could not live with myself if I sold a bike below the standard it was advertised at. Even worse to sell on here, whatever my reputation on here is I'd like to think it's at least honest...
And now, Harry, let us step out into the night and pursue that flighty temptress, adventure.

And that what makes you a BIKER and not just a motorcyclist.

With small claims court I'm not sure that you even need to turn up as its all evidence based from both parties! and no need for a costly and lengthy hearing in court! (but don't quote me on this)

Also does anyone know how long is considered a reasonable length of time to elapse before you could complain to the seller for a refund? so for instance say you owned the bike for a week then found a fault could you still contact the seller for a refund?

Sorry to hear about this. Situations like this can screw you up with reference time money etc. Never buy anything unseen with any value. Think you know this already. Put it down to a bad job and name and shame. All to many times this isnt done and the rogues get away with it.
They are probably penniless and havent got a pot to piss in if that makes you feel better. Hence they rip people off.

I would demand a full refund, no quibbling, with court action if you don't get that straight away.
Don't put any miles on the bike, don't alter anything, and consider getting a pro report on the damage.
Obviously save any correspondence you have with the seller, and don't give him an inch of wriggling room.
You have been duped, you owe him nothing, he needs to sort this out or suffer the consequences of his actions.
Good luck in getting this sorted with minimal hassle.
