The only place I've seen the 45 degree thing mentioned is in that MCN article and they don't put a reference for it.
Maybe they're just wrong.

There is no new guidance, because there is no new law, all that has happened this month is they've increased the fixed penalty for hand held from 3pts / £100 to 6pts / £200

Maybe its a foriegn reporter and they are confusing it with in car video entertainment systems whish must be unviewable by the driver
